Article 1: Scope
These general terms and conditions of sale apply to all transactions carried out on the Systeme.io platform for the purchase of any of the packs of the XanderMotion training program, offered by Alexandre Michalak EI, operating under the name XanderMotion. A "customer" is defined as any natural or legal person placing an order with Alexandre Michalak EI via the secure payment platform.
Your validation of the order summary implies unconditional acceptance of the current terms and conditions, full awareness of their content, and the waiver of any other conditions. It is your responsibility to regularly review the applicable terms and conditions. XanderMotion reserves the right to modify its terms and conditions at any time.
Article 2: Order
By placing an order on the Systeme.io platform, you fully accept these general terms and conditions of sale. You must provide accurate and complete information during the ordering process, including your identity, the recipient's identity, and the delivery address, as well as the email address where an order confirmation can be sent.
No order is binding on XanderMotion until it has been confirmed by email. The information provided during the ordering process is your responsibility: in the event of an error in the recipient's details, XanderMotion cannot be held responsible for any inability to deliver the order. XanderMotion reserves the right to cancel your order if there is a dispute regarding payment for a previous order.
Article 3: Prices
Prices are in US dollars, inclusive of all taxes. The price of items may change at any time, but the price applied to an order is always the one announced at the time of the order. Prices are visible at the time of order summary for the various packages offered by XanderMotion.
Article 4: Payment
Payment is required at the time of ordering, including for pre-order products. You can choose to pay by credit card or PayPal. Secure online payment by credit card is provided by Stripe. The transmitted information is encrypted and cannot be read during transport over the network. Any guarantee regarding the security of this system is entirely the responsibility of Stripe and PayPal, who handle millions of secure payments every day.
Article 5: Access and Delivery
Access to digital products will be through the secure Systeme.io platform. You can access it at any time and view your training in the cloud. Immediately after placing your order, you will receive an email with your login credentials. Please keep them private for easier access to your current and future orders. If you encounter difficulty accessing your order, contact support via email at contact@xandermotion.com.
For customers who have bought the XanderMotion trainin: this training is accessible via the Systeme.io platform and includes all relevant content to enhance your online video creation skills.
Article 6: Warranty and Service Quality
XanderMotion undertakes to provide you with quality training in accordance with the specifications of your confirmed order by email. Please note that the training is subject to an obligation of means and not an obligation of results. Under no circumstances can XanderMotion be held liable for professional or personal decisions made by the beneficiary during the training period or thereafter.
Article 7: Site and Service Availability
Your use of the xandermotion.com website and the systeme.io platform is at your own risk. The service is accessible based on its availability. However, it is possible that, for maintenance needs, intervention on the site or network, or due to other events or disruptions beyond XanderMotion's control, access to the service may be modified, suspended, or interrupted. XanderMotion cannot be held responsible for any losses or damages, direct or indirect, arising from such events or from force majeure, or from the actions of others, or resulting from the use of equipment not adapted to the characteristics of the systeme.io service.
Article 8: Copyright
All elements of the training offered by XanderMotion remain the intellectual and exclusive property of Alexandre Michalak EI. The customer undertakes not to reproduce, disclose, share, or resell the products ordered. Any product purchased on the Systeme.io website is intended for the exclusive use of the buyer and is linked to their own account created on the platform.
Any violation of this clause will result in legal action against the customer. The customer undertakes to respect the copyrights of Alexandre Michalak, the exclusive creator of all the training content. Access to the personal account is reserved exclusively for the person who created the account. The customer undertakes not to share their account access codes with a third party for the purpose of sharing the training content. Each training order is unique and can only be used by one person.
Article 9: Termination Conditions
The client or XanderMotion may, without having to justify themselves, terminate ongoing work at any time. A closing session will then be necessary to complete the process started, regardless of which party initiated the early termination. It is important to note that the interruption of the training does not release the client from their financial obligations. The agreed total payment remains due, even in the event of premature cessation of the training.
Article 10: Personal Data Protection
In accordance with the Data Protection Act of January 6, 1978 (Law No. 78-17), we inform you that you have the right to access, modify, rectify, and withdraw your personal data provided to XanderMotion when using the service. Only XanderMotion is the recipient of this information. By agreeing to these general terms and conditions of sale, you acknowledge having read our privacy policy. By entering your email address on the xandermotion.com or systeme.io website, you will receive emails containing information and/or promotional offers regarding products published by Alexandre Michalak EI. You can unsubscribe at any time by clicking on the link at the end of our emails.
Article 11: Applicable Law
These general terms and conditions of sale are subject to French law. In the event of a dispute, only the courts of Paris have jurisdiction.
